Take-Two Interactive has asked a US federal court to subpoena Microsoft and Discord for records that could identify the people behind a wave of leaked Grand Theft Auto VI footage.
The petitions, filed with the Southern District Court of New York on August 20, give Microsoft and Discord until September 4 to produce the requested information, according to the court filings. One petition also references a GitHub repository where infringing material was posted. Kotaku has all the details.
The filings state that the copyrighted material “includes but is not limited to audiovisual content, artwork, images, dialogue, or other creative elements.” Take-Two’s counsel has submitted a sworn declaration confirming that the subpoenas are sought “to obtain the identity of an alleged infringer or infringers” and that the information will be used only “for the purpose of protecting Take-Two’s rights.”
The clips at the centre of the case have circulated online watermarked by a person or group using the alias “CyberLeek.” They show what appears to be Jason Duval, one of Grand Theft Auto VI’s two playable protagonists, driving, flying an aircraft, using a taser and attacking another character with a wrench.
The leaks have appeared ahead of a Rockstar Games preview of Grand Theft Auto VI due to premiere on Netflix on August 27. The full game is scheduled to launch on November 19, exclusively on Xbox Series X|S and PlayStation 5.
The petition addressed to Microsoft gives the company until September 4 to hand over “all internal Microsoft business records and investigative records associated with Microsoft’s internal investigation of the ‘cyberleek’ persona sufficient to identify the user(s), person(s) and/or entity/ies associated with that persona.” It also seeks data linked to any associated OneDrive or Xbox accounts, including device identifiers such as MachineGuid and Microsoft account details.
The petition to Discord seeks identifying information for all accounts that were members of a list of named servers between June 1 and the present, along with any associated device or telemetry records connected to specified tool or file artefacts.
The leaks follow weeks of scrutiny over Grand Theft Auto VI’s launch plans.
